Whistleblower law book and gavel in a court.During this year’s inaugural Whistleblower Law Practice Accelerator conference put on by TAFEF, False Claims Act attorney Nathaniel Smith moderated a panel titled “FCA Settlements: Strategies and Considerations.” Along with Nathaniel, the panel included other experienced False Claims Act attorneys James Breen of Breen Law Firm, P.A., Susan Gouinlock of Wilbanks & Gouinlock, LLP, and Jeremy Friedman of the Law Office of Jeremy L. Friedman. The panel discussed what to consider in deciding how and when to settle, relator’s share, attorneys’ fees, and how to deal with the government, the defendants, and also other relators in multiple-relator cases. For Nathaniel, a key takeaway was that the settlement process is dynamic, and no one formula applies.
