Fraud against the U.S. Department of Defense can be the basis of False Claims Act lawsuits because it hires contractors to produce weapons systems and military equipment and to support military efforts around the globe, but policing all of the contracts with the DoD would be impossible for the government.
Conduct that may be the basis of a False Claims Act or Qui Tam claim includes:
- failing to comply with contract specifications, including cutting agreed-to costs, and skipping quality tests that were a part of the contract
- substituting substandard materials or failing to meet contract specifications
- rigging bids
- failing to pay workers as required under the contract
- inflating costs to get a higher price (may be violation of Truth in Negotiations Act)
