1. What is going wrong with CertainTeed’s Shingles?
CertainTeed organic shingles produced after 1987 have reportedly been having similar patterns of deterioration – curling, cracking, and degranulation.
Curling: According to reports by homeowners, some organic shingles have curling along the edges, which disrupts water flow and causes serious damage within the house.
Cracking: Another common problem is cracking down the middle, leaving their house open to water damage.
Degranulation: The third common problem is degranulation, which is when the tiny pebbles fall off of the shingles and into the gutters of the house.
If you are experiencing any of these three problems, you may be able to participate in the case. If you are not experiencing these problems, but your shingles are still faulty, proceed to question eight.
2. I’m having problems with my shingles. What should I do?
If you are having problems associated with CertainTeed’s shingles, you have two possible options:
Your first option is to pursue the warranty provided by CertainTeed. If you accept any money from CertainTeed for the replacement of your shingles, you cannot participate in the case.
Your second option is to participate in the case by first filling out a CertainTeed Shingles Class Action Lawsuit intake form, available on our website here. After we have reviewed this form, you will be sent a confirmation e-mail with further instructions.
3. Why should I participate in the lawsuit rather than accept the warranty CertainTeed has sent me?
Generally, CertainTeed only offers to pay for a portion of the cost of shingles, as well as provides a discount towards the purchase of new CertainTeed shingles. In the suit, we are not only pursuing the cost of shingles, but also labor costs associated with reinstalling a roof as well as the cost of any damages resultant from the faulty shingles.
4. I want to be involved in the case. What sort of information should I be compiling?
You should collect any and all paperwork documenting the installation of CertainTeed shingles as well as any documentation of costs resultant form the faulty shingles. In addition, you should save three or more faulty shingles and keep these in a dry place where they will not deteriorate. You should also try to obtain photographs of your damaged roof if you can do so safely. You may be called upon to produce these as evidence that you owned CertainTeed shingles.
5. CertainTeed has sent me warranty information and an offer for my shingles. Can I still participate in the case?
You still may communicate with CertainTeed without jeopardizing your involvement with the case. However, if you accept any money from CertainTeed for the replacement of your shingles, you may no longer participate. If you had previously informed Halunen & Associates that you were a participant (i.e. filled out the online form), please contact us and we will remove you from our database.
6. I’m a second (third, forth, etc.) owner of my house. Can I still participate in the case?
Regardless of what CertainTeed has told you, second owners may participate in the case. You should try to procure documented proof that the shingles on your roof are CertainTeed shingles, as well as collect any and all paperwork from the original roofing job (receipts, warranty information, etc.).
7. Can I re-roof my house and still participate in the case?
You may re-roof your house without jeopardizing your involvement in the case. However, it is necessary that you collect any and all paperwork documenting the costs of re-roofing. In addition, you should save three or more faulty shingles and keep these in a dry place where they will not deteriorate. You should also obtain photographs of your damaged roof before re-roofing your house. You may be called upon to produce these as evidence that you had faulty shingles.
8.How do I find out new information about the suit?
New information will be added to the website as it becomes available. Check the “Top Stories” second on the left-hand toolbar to see if there have recently been any updates.
9. When will the case be resolved?
Because of the magnitude of the cases and the organizational rigor required, class action suits tend to move slower than most civil suits. This particular case will take approximately one to three years to be completed.
10. How much does it cost to participate in the suit?
There is no cost for participating in the lawsuit. All we need to do is to put information into a database, which will later be processed by a judge in order to assess damages wrought by CertainTeed. Attorneys are paid on a contingency basis determined by the judge.
11. My shingles don’t have the problems described in question one, but still are malfunctioning (i.e. blowing off as a result of wind). Can I still participate in the case?
These problems are more likely associated with CertainTeed’s fiberglass shingles, and thus are outside the scope of this lawsuit. You must verify if your shingles are organic or fiberglass. Below is a list of CertainTeed’s shingles. Only the organic shingles are included in this lawsuit.
