Cell Phone Companies’ Misclassification of Store Managers
Halunen & Associates is investigating possible misclassification of store managers by cell phone companies. In the past several years, some cell phone companies may have misclassified their store managers as “exempt” from protections guaranteed to employees under the Fair Labor Standards Act, such as overtime pay. Under an “exempt” status, the companies pay their employees a salary instead of an hourly wage, and require them to work more than forty hours per week without additional compensation or overtime pay. In fact, however, if store managers have limited management responsibilities but are required to work overtime, they are likely to qualify for overtime pay. Companies we are investigating for possibly exercising these practices include:
- All Star Wireless
- AT&T Wireless
- Choice Wireless
- InTouch Wireless
- Sprint Wireless
- T-Mobile
- The Mobile Solution
- Top Mobile
- Verizon Wireless
Our investigation does not suggest that any of these companies are in fact guilty of misclassification. However, if you have been employed by one of these companies and you feel you may have been misclassified, please do not hesitate to call us or fill out a contact form. We are not only dedicated to servicing Minneapolis and Minnesota, but will investigate practices in other states, and associate with local attorneys when appropriate.
