Halunen & Associates files class action lawsuit against SOH Distribution for driver misclassification


Halunen & Associates is representing delivery drivers in a class action lawsuit against SOH Distribution, a subsidiary of Snyder’s of Hanover, for misclassifying its drivers as independent contractors rather than as employees. This class action lawsuit is taking place in federal court in the Middle District of Pennsylvania.

The lawsuit challenges SOH’s classification of pick up and delivery drivers as independent contractors. SOH requires drivers to purchase or lease their trucks and pay for all operating expenses, including workers compensation insurance, liability insurance, fuel, maintenance, etc. SOH also fails to reimburse their drivers for business expenses, pay employee benefits, notify them about family medical leave rights, or pay overtime wages. SOH misrepresents the truth about the real relationship between their drivers and the company. Our suit seeks, among other things, reimbursement of business expenses, wage deductions, damages as a result of SOH’s misrepresentations and unfair business practices, and an order prohibiting SOH from continuing to violate the laws.

You may be part of the case if you worked as a pickup and delivery driver for SOH and were classified as an “independent contractor.” However, you are not required to do anything at this time.
