Halunen & Associates is investigating possible misclassification of store managers by Valvoline Instant Oil Change. In the past several years, some companies have misclassified their store managers as “exempt” from protections guaranteed to employees under the Fair Labor Standards Act, such as overtime pay. Under an “exempt” status, the companies pay their employees a salary instead of an hourly wage, and require them to work more than forty hours per week without additional compensation or overtime pay. However, if store managers have limited management responsibilities but are required to work overtime, they are likely to qualify for overtime pay.
Our investigation does not suggest that this company is in fact guilty of misclassification.
