Kerry Foods Class Action Lawsuit
Employees for Kerry Foods company may be entitled to more overtime pay than they are actually receiving. As part of their jobs, Kerry Foods employees are required to wear company-supplied uniforms and protective equipment, including boots, hair nets, smocks, aprons, and rain gear. Kerry Foods refuses to compensate its line employees for the time spent at the beginning of shifts changing into and sanitizing required gear and equipment, and at the end of shifts for removing and cleaning these same items. Similarly, Kerry Foods refuses to compensate employees for time spent donning and doffing such equipment before and after their unpaid lunch breaks and other breaks.
Under the Fair Labor Standards Act of 1938, employers are required to pay employees for all hours in which the employee is “suffered or permitted to work,” including preparatory and concluding time. Changing into and out of company uniforms and work sanitation/protective gear may be covered under “time spent working” of the FLSA.
Halunen & Associates is currently pursuing a class action lawsuit across the country seeking damages including all overtime pay owed to Kerry Foods workers as well as additional fines and fees as imposed by the courts.
