CertainTeed Shingles Class Action Lawsuit


Halunen & Associates, together with other class action law firms across the country, has brought a class action lawsuit against CertainTeed Corporation on behalf of consumers who have been affected by deteriorating, curling, or otherwise defective CertainTeed organic shingles made by the company. This case involves anyone who has previously owned, or currently owns, a home or other structure from 1987 through the present on which CertainTeed organic shingles were installed. We are seeking recovery of material costs and labor costs for the tear-off, removal and re-application of shingles for each member of the class. To date, we have identified class representatives in several states, including: IA, IL, IN, KY, MI, MN, MO, MT, ND, NE, NY, OH, PA, SC, SD, WI. Our intent is to file this class action lawsuit, state by state, on an ongoing basis. We are still looking for plaintiffs from additional states to strengthen the case against CertainTeed.

Updates:
As of June, 2008, the CertainTeed class action continues to collect evidence for the states that have already been transferred to the U.S. District Court in the Eastern District of Pennsylvania, where CertainTeed is located. We have filed for a national class certification, which would allow this case to proceed on a national level rather than state by state. We expect a decision by the end of the summer. Alternatively, we are in the process of filing claims in Colorado, Texas, North Carolina, Missouri, New Hampshire, New Jersey, Utah, Virginia, and Canada. Our claim is that CertainTeed knowingly designed, manufactured and marketed faulty shingles, which has been corroborated by our ongoing discovery in the case.
Given the sheer volume of documents that will require review and analysis, Plaintiffs’ counsel will soon begin taking deposition testimony of fact witnesses. The Defendant has also begun taking the depositions of class representatives at this time as well.
We continue to review and analyze documents we have acquired from CertainTeed and have assembled a case that, we believe, will effectively substantiate our claim. As they are being reviewed, it is becoming increasingly evident that CertainTeed knowingly produced shingles that were deteriorating prematurely. Furthermore we have obtained experts who will support our claims that CertainTeed’s shingles are defective and would not be expected to endure normal wear and tear.
To participate in this case, you must verify that you have CertainTeed’s organic shingles. While many customers may have been experiencing problems with their fiberglass shingles, those claims are outside the scope of this lawsuit.
