Halunen Law attorneys Michelle Dye Neumann and Brian Rochel, along with Steven A. Smith, a partner of Nichols Kaster, provided advice to the Minnesota State Bar Association’s Human Rights Committee on the right to a jury trial under the Minnesota Human Rights Act (MHRA). The Human Rights Committee advises on legislative positions taken by the MSBA. The MHRA was amended in 1973 to deny the right to a jury trial and it is unclear whether the amendment violates the Minnesota Constitution’s guarantee of right to a jury trial. Ms. Neumann and Mr. Rochel provided insight on the current state of the law and the negative legal and public policy impacts of denying a jury trial to victims of discrimination and retaliation.
