Types of Qui Tam Fraud
The government cannot fight fraud alone. It relies on private citizens who have information about fraud to start False Claims Act cases. They do this by coming forward and “blowing the whistle” on fraudulent practices that cheat the government.
Below are several types of fraud that have resulted in qui tam or False Claim Act recoveries:
- Health Care Fraud: illegal activity in the health care industry includes when a company, agency or health care provider bills for services it does not provide, markets drugs off-label, accepts illegal kickbacks, or fails to provide adequate nursing home services.
- Defense Fraud: this conduct involves fraud against the U.S. Department of Defense as it hires contractors to produce weapons systems and military equipment and to support military efforts around the globe. Fraudulent conduct includes illegally inflating prices, misusing money and time, and substituting inferior parts or products.
- Education Fraud: schools that falsify records to receive state and federal education monies may be liable for fraud under the False Claims Act.
- Goods and Services Fraud: this type of fraud occurs when a business or agency lies to the government to get government business, or receive government payment, services or subsidies. This includes agricultural subsidy fraud, overcharging for the completion of public works or government construction projects, misuse of funds allocated for scientific research, or overcharging the government for the cleanup of toxic waste, and many other types of deceptive conduct.
